Dear Ms. Bastian,

In a telephone conversation yesterday, we discussed plans for a wedding celebration at Sabuga. I want to confirm your plans.
The date for the wedding celebration is on January 11. 11.00- 15:00 And the 850 invited guests will attend. we will need a large space to accommodate all the invited guests
As we have discussed, we will need 10 tables and 75 chairs, microphones, speakers, air conditioning, tables, chairs, projectors and indoor decorations.
At 9 pm, we will serve you dinner. I would appreciate you fax me with the menu selection immediately. but none of the last of 11 January.
I also will receive the projected costs for the celebration of our day, you do not need to include the cost of catering eat , can be sent via fax or e-mail me the projected cost by 31 December. I will give you a confirmation by the end of our booking on 31 December.
I want to thank you for your help in planning a wedding celebration us.I hope to see you next week when I see you have other amenities.

Thank you for your letter sent on 28 November. letter stating your interest in the Sabuga . This letter is our confirmation. The next call to discuss the cost of your wedding
We understand you want to book the facilities in the building Sabuga on 11 January. With 850 invited guests. And you'll need one large room that can accommodate all the guests you invite.
As you requested, we will provide 10 tables and 85 chairs, microphones, and speakers, as well as a large room projector. These requests may be submitted two weeks prior to the date of the wedding celebration.
As you requested, I will fax the projected costs on 31 December, and once you decide what is needed and what kind of food, we can complete the estimated costs.

I appreciate you for planning a reception in our building, we hope to show you when you visit our facility this week.

Chevron Divonis Denda Rp 2,5 Milyard (Kasus Persaingan Pasar Tidak Sehat)

Contoh Kasus Persaingan Pasar Tidak Sehat :


JAKARTA. Raksasa perusahaan minyak Chevron Indonesia Company divonis bersalah melakukan tindakan diskriminasi dalam tender export pipeline front end enggineering & design contract. Komisi Pengawas Persaingan Usaha (KPPU) menghukum Chevron membayar denda sebesar Rp 2,5 miliar.

“Menyatakan bahwa terlapor I (Chevron) terbukti secara sah dan menyakinkan melanggar Pasal 19 Huruf D Undang-Undang Nomor 5 Tahun 1999,” kata Ketua Majelis Komisi Muhammad Nawir Messi, Kamis (16/5).
Dalam Pasal 19 Huruf d disebutkan pelaku usaha dilarang melakukan satu atau beberapa kegiatan, baik sendiri maupun bersama pelaku uasaha lain yang dapat mengakibatkan terjadinya praktek monopoli atau persaingan usaha tidak sehat berupa melakukan praktek diskriminasi terhadap pelaku usaha tertentu.
Sementara itu, Majelis Komisi juga memutuskan bahwa PT Worley Parsons Indonesia (terlapor II) tidak terbukti melanggar Pasal 19 Huruf D UU No. 5 Tahun 1999. Chevron disebutkan melakukan praktek diskriminasi terhadap peserta tender lainnya yakni PT Wood Group Indonesia. Sementara itu, Chevron telah menetapkan PT Worley Parsons (terlapor II) selaku pemenang tender.
Terkait putusan ini, Stefanus Haryanto, Kuasa Hukum Chevron, enggan untuk memberikan komentarnya. “No comment ya,” katanya. Hal serupa juga disampaikan oleh Mochmad Fachri selaku kuasa hukum Worley Parsons.
Perkara ini berawal dari penyelidikan terhadap Resume Monitoring KPPU RI mengenai adanya Dugaan Pelanggaran Pasal 19 huruf d dan Pasal 22 Undang-Undang Nomor 5 Tahun 1999 pada Dugaan Pelanggaran Undang-Undang Nomor 5 Tahun 1999 terkait dengan Tender Export Pipeline Front End Engineering & Design Contract (No. C732791) di Lingkungan Chevron Indonesia Company, yang dilakukan oleh Chevron Indonesia Company sebagai Terlapor I dan PT Worley Parsons Indonesia sebagai Terlapor II.
Objek perkara ini adalah Tender Export Pipeline Front End Engineering & Design Contract (No. C732791) di Lingkungan Chevron Indonesia Company dengan total estimate contract value sebesar 4.690.058 US$. Tender ini menggunakan sistem pemasukan penawaran dua tahap berdasarkan PTK 007 Revisi 1 Tahun 2009, yang terdiri dari tahap teknis dan tahap komersial.

Analisis Contoh Kasus di atas
A. Analisa Bukti
Dari penjelasan Kasus diatas dapat di analisa raksasa perusahaan minyak Chevron Indonesia Company divonis bersalah melakukan tindakan diskriminasi dalam tender export pipeline front end enggineering & design contract. Dan perusahaan minyak Chevron disebutkan melakukan praktek diskriminasi terhadap peserta tender lainnya yakni PT Wood Group Indonesia. Sementara itu, Chevron telah menetapkan PT Worley Parsons (terlapor II) selaku pemenang tender.
B. UU yang berlaku
Dalam kasus ini UU yang dikenai Pasal 19 Huruf D Undang-Undang Nomor 5 Tahun 1999. Dalam Pasal 19 Huruf  D disebutkan Pelaku usaha dilarang melakukan satu atau beberapa kegiatan, baik sendiri maupun bersama pelaku usaha lain, yang dapat mengakibatkan terjadinya praktek monopoli dan atau persaingan usaha tidak sehat berupa melakukan praktek diskriminasi terhadap pelaku usaha tertentu.”
C. Hukuman yang Berlaku
Dalam kasus di atas dapat dilihat dari UU (Undang-Undang Nomor 5 Tahun 1999) yang berlaku maka pelaku dapat hukuman pidana denda serendah-rendahnya Rp 25.000.000.000,00 (dua puluh lima miliar rupiah) dan setinggi-tingginya Rp 100.000.000.000,00 (seratus miliar rupiah), atau pidana kurungan pengganti denda selama-lamanya 6 (enam) bulan.
E. Objek Perkara
Objek perkara ini adalah Tender Export Pipeline Front End Engineering & Design Contract (No. C732791) di Lingkungan Chevron Indonesia Company dengan total estimate contract value sebesar 4.690.058 US$. Tender ini menggunakan sistem pemasukan penawaran dua tahap berdasarkan PTK 007 Revisi 1 Tahun 2009, yang terdiri dari tahap teknis dan tahap komersial.
E. Tanggapan
Dari Kasus tersebut saya menanggapi bahwa undang-undang larangan praktik monopoli dan persaingan usaha tidak sehat itu perlu karena kita tidak ingin perekonomian negara ini hanya dikuasai oleh segelintir orang atau pengusaha yang memiliki pangsa pasar yang monopolistis dan persaingan tidak sehat lainnya. Dan Komisi Pengawas Persaingan Usaha (KPPU) sebagai lembaga yang mengawasi tentang persainagn usaha harus tegas terhadap perusahaan-perusahan besar ataupun kecil yang melakukan tindakan monopoli. Supaya tidak terjadi kesenjangan sosial yang amat dalam antara penduduk Indonesia
